Does anyone know who owns the copyright on the Borrower photos? Kiva? The MFI? I want to revamp my philanthropy related website and using some of the lender photos would be wonderful. But, I don't want to do anything inappropriate.

I may have to email Kiva and ask, but before I pester them, I wanted to check if anyone already knows...

Generally, the copyright is retained by the subject of the photograph, UNLESS the contract the borrower with the MFI and/or KIVA stipulates otherwise, which I strongly suspect is the case since BOTH the MFI and KIVA know the photo will be appearing on the Internet. There is "property" in a likeness, from which an individual can be identified which is the reason contest winners have to sign a release permitting their photo, name and other identifying information to be published.

Sherri - I remember on one of the calendar threads Fiona (I think that was who it was) wrote about the need to coordinate with them for the 2009 calendar so that proper permissions were obtained etc.  I think the same would apply here, although there is a general exception for "personal use" (which I think posting a borrower picture on your non-commercial personal blog would fit under).

Anyway, hopefully that will at least point you in the right direction.

On copyright: Yes, there is an issue with that. It seems Kiva has not retained any copyrights on the pictures, so it still belongs to the borrowers. That is why she wants to make sure she gets proper permission prior to the calendar.

Also, when checking the image gallery on Kiva.org, I saw they removed the sentence that used to be there: that all pictures on Kiva.org were free for use...seems to be an issue really. So Sherri, I don't know for sure. You want to ask Fiona, I guess...fiona (at) kiva.org.

I saw a few of the KivaFriends photos highlighted...

It is interesting that the lender profiles have the phrase "Lender testimonials and pictures on this page have been approved by each Kiva Lender for publication. "

The entrepreneur profiles however do not.  I wonder if that means anything?

Kiva can probably use the photos as they please, but that permission no longer extends to those beyond Kiva.  Maybe it was something the lawyers recently advised on.
