Part of the problem is that the relationship between Kiva and its lenders is not legally defined with any precision.  Perhaps this is a conscious effort to avoid certain industry's regulation.  So they are avoiding words like deposit, investment, security and so forth.  But by having no clear legal definition, it is equally unclear how to find legal ways with dealing with this problem.  This lack of clarity needs to be cleared up before this problem can be fully addressed.  (And it might be too late to fix pre-existing conditions)

One area that I think has promise is in contract law.  Contracts need to be fully agreed upon by both parties, but have the advantage of allowing predetermined actions to occur if certain circumstances become reality.  Monies held under contract are not normally subject to escheat when there remain future triggers which require action on the funds. (A poor example is a security deposit on real estate.)

Joan, Premal posted that there would be a call TOMORROW on this topic and others, and that "the policy - whatever is decided - will not be in force until after the call."  I am looking forward to this call.

Just want to let you know that we're following this thread closely and that the feedback is being considered.  I'd love to set up a Kiva "Community Conference Call" where we could discuss this issue and any other issue.  I know Gerard will be publishing the conference call invitation on the Kiva Blog so lenders not on Kiva Friends can discover it.

Based on how this goes, I'd like to schedule a similar call with Matt or myself and others on the Kiva team on a periodic basis.

I doubt that there will be an "official" transcript (there has not been one - at least not that I know of - regarding the two recent "MIFEX conference calls"), but hopefully some members here will volunteer to provide us with a brief summary?  Wink pretty please  Grin

Kiva was supposed to record & post a transcript of a conference call from a couple of weeks ago but due to "technical difficulties" that never materialized.
                                                                                                                                       
Based on that one experience it is hard to say. We should know more tomorrow.

P.S. The second MIFEX call was not recorded & Kiva had not planned to do so (I was on both calls).

I suspect the call is the post lunch time for Kiva staff.  If you live in California, it is smack dab in the middle of work hours which might also be inconvenient for many with jobs.  Many jobs don't allow an hour mid afternoon break.  For me, I have a school appointment at 1:15, and school pickup is at 2:30pm, in the middle of the hour chat.  So, sometimes life gets in the way of Kiva.   Laugh

Whoever, does make chat, please represent and then present!

I should have made myself clearer.  I wasn't suggesting that the actual timing of the call was US-centric, just that the presentation of the time ("2pm PST / 5pm EST") could usefully have included a little nod towards the many Kiva lenders in Europe and Australia and elsewhere who will be able to join the call.
